La Trinidad officials to regulate waste transfer station operation

Taking cue from the incident at the Lamtang transfer station in Barangay Puguis, the La Trinidad Municipal Council proposes for the regulation of the setup and operation of solid waste transfer facilities in the locality.

The ordinance, authored by Councilor Nestor Fongwan, Jr. chair of the committee on solid waste management and environment, stated the proponent must acquire all requirements prior to establishing a waste transfer station. This include the written intent addressed to the mayor; locational clearance from the Municipal Planning and Development Office; environmental compliance certificate or certificate of non-compliance; endorsements from the affected community, barangay council, sangguniang bayan, mayor’s permit and free prior and informed consent from affected indigenous peoples.

Also, in operating a solid waste transfer station, it must not be located near houses, churches and schools within 100-meter radius.

“It shall be designed and operated for efficient waste handling and capacity and in compliance with standards and guidelines pursuant to Republic Act 9003 and other regulations,” the proposed ordinance stated.

Proponents of transfer stations must also see to it that the construction and design of the facility are approved by the MPDO prior to construction. The facility should have proper leachate and drainage controls that must not come in contact with surface and ground water.

The proponents must also maintain a daily logbook recording the volume of wastes received and transferred to be submitted to the General Services Office of the municipality for tracking.

Waste must be removed from the transfer station within 24 hours.

Those found violating the ordinance shall be meted with a fine not exceeding P2,500 or an imprisonment of not more than six months or both depending on the discretion of the court. This would also include closure or stoppage of its operation after issuance of three notices of violations.

The proposed ordinance is set for second reading.

Recently, the the operation of the solid waste transfer station operated by M.A. Camilo Freight Services at Sitio Lamtang was ordered by Judge Emmanuel Rasing of Regional Trial Court Branch 10 to be totally closed by Dec. 22.

The court has ordered the hauler to also mitigate the stench and leachate of the garbage being hauled and transferred from the area.

The Camilo trucking services hauls the garbage of Baguio City and stages it at the transfer station prior to hauling to the Capas sanitary landfill. 

A tripartite monitoring team led by Engr. Nestor Donaal, Jr. of the Environment and Management Bureau, Nestor Lucas as representative of the petitioners and Lester Madino, environment management specialist from La Trinidad LGU was formed. The monitoring team will see to it that the Camilo trucking services  is complying with the court order.
