Issues raised in general assembly

May we inform through you prestigious Midland Courier what transpired during the Dec. 5 Beneco General Assembly in Acop, Tublay, Benguet.

Agenda wise, the focus of discussions was the previous minutes and the joint report of the board of directors chair and Beneco general manager. There was no unfinished business and new business except the five proposals from a concerned member and National Association of Electricity Consumers for Reform (Nasecore). First proposal was to reduce the compensation, remuneration, and allowances of the board of directors by 75 percent for savings and service purposes. The second proposal was education qualifications for board candidates to be a four-year college degree with the justification to ensure working knowledge on cooperative, laws, rules, and regulations in the power industry. The two proposals by member Atty. Bolislis were rejected by the body.

The third to fifth issues were presented by Nasecore. First, regarding the refund of electricity meter deposits to Beneco members in the amount of P75,000,000. The Energy Regulatory Commission has finally decided and directed Beneco to prepare a refund scheme. Another issue is for Beneco to refund to member-consumers the over charged collection made during the period January 1999 to April 2004. Total amount is P33,946,939. ERC has finally decided and directed Beneco to refund what it over collected. And last is for Beneco to refund the discount resulting from the approval of the Energy Supply Contract between Beneco and Mirant. ERC decided on June 30, 2008 under its order Case 2005-051RC which mandated Beneco to refund the discount of P0.02075 per kWh to its consumers. The amount is P84,000,000. Thus, the total obligation of Beneco is P193.5 M.

Beneco’s board’s actions on the three issues were just to appeal their case.

There are other important matters to resolve such as conversion to stock cooperative pursuant to the EPIRA Law, investment shares for the consumer-members, patronage refund, tax payment scheme pursuant to RA 9520 ad update of list of members.

Another issue if the account receivables and cash advances of directors in the amount of P4,141,915.03 out of which P2,544,404.72 is still unliquidated as of Aug. 25. Will they liquidate and when?
