La Trinidad, Benguet Mayor Romeo Salda has issued a demolition order to Pines City Doctor’s Hospital over the fence it has built on its property at Cogcoga, Pico due to lack of permits.
In an order issued July 7, the mayor directed the municipal building official to implement the demolition on July 12 or on subsequent dates if the order will not be followed by PCDH.
The mayor has also ordered the La Trinidad Municipal Police Station to be deployed at the site where the demolition will take place to maintain peace and order.
Salda said on June 23, the municipal government sent an omnibus order to PCDH to explain within three days of receipt of the order why it constructed a fence, but PCDH representative Antonio Anaban Jr. did not respond to the order.
PCDH’s construction of a hollow block fence prevented vehicles from entering and only narrow entrance was left open for residents to enter.
The fence is also said to be located in a road lot, which should not be closed, according to the Municipal Planning and Development Office.
The MPDO cited Section 50 of Presidential Decree 1529 or the Property Registration Decree, which states, “Except by way of donation in favor of the national government, province or city or municipality, no portion of any street, passageway, waterway or open space so delineated on the plan, shall be closed or otherwise disposed of by the registered owner, without the approval of the Court of First Instance of the province or city, in which the land is situated.”
